We are pleased to provide everyone copy of the MR filed at Branch 24 Manila RTC regarding the preliminary injunction issued by said court. Said case was filed sometime on November 2008.
We are humbly reporting to all Mechanical Engineers and the general membership of the PSME, that our Society is wracked by a national leadership struggle resulting from the PSME national directors election controversy in 2006. Such intra-corporate dispute of the PSME was filed sometime on December 2006, entilted “Cleofas Maceda, et
al vs Vicente Vosotros, et al” and docketed as Q-06-164, and is still before Branch 90 Quezon City RTC. Thus, the succeeding set of national officers of PSME of any group were just a product of the election controversy in 2006.
The original national leadership issue of PSME is still pending in Branch 90 QC RTC, filed sometime in 2006. The other group of PSME filed another legitimacy case in Manila RTC sometime in 2008, which is simply a forum shopping.
As openly declared during an open court session in Br 90 QC RTC, the court informed both groups present at that, to have collection of fees, but the court will see to it that there will be an official audit for both sides since 2007, to be supervised by the court. According to the court, all funds collected and existing from both groups should go to the PSME. Our group (MACEDA group) is open to any audit. When we assumed the PSME National Headquarters in 2007, there was zero PSME national funds in our hands.
Sometime in 2006, the duly elected PSME National Treasurer, Engr. Alex Pamplona documented his turn over of the PSME National funds and the PSME trust funds of Php7M to the 2006 Acting PSME National President, Engr. Ramon Solis.
The PSME national controversy started in 2006 when the duly elected PSME National President Engr. Edimar Salcedo was forcibly impeached during their August national board meeting in Davao City. This move was hatched by the group of Engr. Ramon Solis, 2006 EVP and Engr. Joli Borja, 2006 VP Internal. After that incident, Solis take over the PSME National, but several 2006 duly elected national officers and directors, tender their irrevocable resignation sometime in September 2006. The group of Solis run the PSME National Convention in 2006. Engr. Joly Borja signify his interest to run as PSME National President. Engr. Ma. Cleofas Maceda was also a candidate of the PSME National Director in 2006 election of PSME, and was the close rival for the PSME National Presidency by Engr. Joli Borja. Engr. Borja did not make it to the top 15 PSME winners national directors for 2007. The tallying of votes was already done at that time, yet there was still no proclamation of the 15 winners director-elect. A few minutes later, still without the official proclamation, Engr. Rafael Alunan, a winner in the tally of votes representing NCR, filed his irrevocable resignation as director-elect of PSME in favor of Engr. Joli Borja. As part of the strategy of our group at that time, in order that the 2006 PSME Comelec will act with dispatch, honor and integrity, 3 winners of the PSME 2006 election, as per the tallying of votes, Engr. Ma. Cleofas Maceda, Engr. Caloy Ancis and Engr. Rolly Balmes filed their letter of withdrawal as director-elect. The letter although handwritten was carefully weighed and done, and it was the belief and conviction that their letter should not be acted by PSME Comelec, considering that the tallying of votes was already finished. Besides, as per the PSME By-Laws and Omnibus Election Law, it is not the role of the Comelec to act on any resignation of the director-elect. Comelec should proclaim first the winners and it will be the functions of the new Board to act for any resignation. It has been an open knowledge during the election of 2006 and since then, with all the events that happened, on who is behind of all these controversy of the PSME. Your guess is as good as our guess. The truth will always come out and it will set us free, no matter hard it is.
And the rest was history. The intra-corporate dispute is now in Branch 90 QC RTC. The case in Branch 90 is a case of the interpretation of the PSME By-Laws and Policy Manual. Our fervent prayer is for the court to resolve the case based on merits, because the order of that case in court will give precedent and give guidelines in future elections of the PSME. In the future, there will be no more elders who want to emerge as kingmakers for the PSME.
By the way, for the information of everyone, the composition of the 2006 PSME Comelec were the following: Engr. Gaudencio de Guzman, Chairman; Engr. Victorino Sianghio, Member; and Engr. Ernie Casis, Member. Do you know also that these two members of the 2006 PSME Comelec were the prime mover in the filing of the irrevocable resignation of Alunan, in order that Borja will be proclaimed as among the 15 winners director-elect. Also, Engr Sianghio and Engr. Casis are the plaintiffs in PRC Admin 779 case filed against Engr. Gaudencio de Guzman, for unprofessional/dishonorable conduct. And of course, the Chairman of the BME at that time when the case was filed was Engr. Alfredo Y. Po. According to the allegations of Engr. Sianghio and Casis, Engr de Guzman acted unprofessional when he conduct the election of the PSME National President for 2007, and when Engr. de Guzman announced on the last night of the 2006 PSME Convention proclaiming the 15 winners director elect for 2007.
PRC Admin Case 779 is just pure harassment, just like the PRC Admin Case No. 781 filed by Borja against Edimar Salcedo, Ma. Cleofas Maceda, Roberto Lozada, Fernando Cala, Cesar Candor, Eric Gutierrez, Antonio Avellanosa, Jerry Adorador, for unprofessional/dishonorbale conduct. In PRC Case 781, Borja allegedly filed the case because the defendants coerced the security guards their group hired to manned the PSME National Headquarters. Sometime in November 2006, Acting PSME National President Ramon Solis issued suspension order to the regular employees of PSME and they closed and padlocked the PSME National Bldg. Sometime in January 2007, when Engr. Maceda will assume her Presidency, their group opened the PSME National Headquarters. Since then, the PSME National Bldg is open and was never closed for the general membership. Another harassment case was filed, through PRC Admin Case 783 filed by Engr. Vicente Vosotros against Engr. Ma. Cleofas Maceda for unprofessional/dishonorbale conduct.
Also, Engr. Ramon Solis filed forcible entry case against Engr. Edimar Salcedo and Engr. Ma. Cleofas Maceda sometime in 2007, at Branch 33 QC MTC. The defendants won the said case at the MTC Branch 33. This is now on appeal and consolidated at Branch 90 QC RTC.
Again, the rest was history, and our group, with conviction, honor and integrity was, and is, and will continue to fight for what is right for the PSME. We are binded not for money and power, because we do not have those at the moment. In fact, we were always deprived, even harassed of our roles as PSME in PRC-BME.
Yet, we have done our role for the benefit of all mechanical engineers, even if we received several harassment from PRC, civil and criminal cases from courts and prosecutors office. Our group was the prime mover for the suspension in 2009 of the Certificate of Good Standing as a pre-requisite in the renewal of professional license at PRC. As long as any requirements being hatched by the other groups will not be a requirement in the renewal of our professional license, our group will not question it.
